The court said that the Election Commission is a constitutional body. His work cannot be interfered with. The order was passed by the bench of Justice AR Masoodi and Justice Suresh Kumar Gupta on the petition of Rishi Kumar Trivedi.
It was demanded in the petition that in view of the current situation of the epidemic, the Election Commission should be ordered not to conduct the Legislative Assembly elections of Uttar Pradesh in the months of February and March and postpone it till the situation of the epidemic becomes normal.
The Court criticized the petitioner saying that before filing the petition, he did not bother to get the notification of the first phase of the Legislative Assembly elections. It is procedurally illegal to simply order postponement of elections without challenging the notification of the Election Commission.

The court has also sent a copy of the notice to the Commissioner of Police, Lucknow for disciplinary proceedings. In which it has been said that for the last several months, a report is being summoned by the court from the police station on the applications related to surrender application, bail application and release of the vehicle. But there is no report of any kind from the police station.
The court said that the act of the police station in this way is very objectionable and is in violation of the order of the court. The court has issued a notice to the police station chief, asking him to appear before the court and explain why and under what circumstances the report sought by the court is not being sent by him.

Chief Judicial Magistrate Ravi Kumar Gupta has summoned a report for February 22 from the police station Gosaiganj on the application seeking to file a murder report against eight people, including the jail superintendent, in connection with the death of an undertrial prisoner in the District Jail Lucknow. Jail Superintendent, Deputy Superintendent of Jail, Chief Prisoner Guard, Prisoner Guard Shohrab alias Shoaib, Naseem and Shamshad have been made accused in the application filed before the court by Lali Devi, wife of prisoner Rupesh Kumar Prajapati. In which it is said that Vadini’s husband was sent to jail on 12 August 2021 in a criminal case of robbery in District Jail Lucknow.
It has been said in the application that when Vadini’s brother Upendra and maternal uncle Ram Asare had gone to meet the deceased Rupesh Kumar Prajapati in jail, he had told that Shohrab alias Shoaib, Naseem, Shamshad, Kamlesh, Sandeep, Ashok, Santosh Kumar and jail administration He is being harassed a lot by the officials of the jail, he is being mistreated and he is being harassed by the jail staff and officials for not having money. In the report sent to Police Station Gosaiganj, Vadini Lali Devi has said that her husband was murdered on October 25, 2021 and the case is being hushed up and the evidence is being erased by giving it the form of suicide. Due to which it is necessary to file a case report.
5- Bail applications of 4 accused in the conversion case rejected
Special Judge Kalpana of ATS Court has rejected the bail applications of Abdullah Umar, Bhupriya Bando alias Arslan Mustafa, Adam alias Prasad Rameshwar Kanwre and Dr. Kunal Ashok Choudhary, accused of luring people to convert them.
On behalf of the prosecution, Joint Director Atul Kumar Ojha opposed the bail applications and said that the report of the case was lodged by the plaintiff, Sub Inspector Vinod Kumar in the police station ATS Gomti Nagar. In which it was alleged that some anti-national anti-social elements are changing the population balance of the country at a rapid pace by converting people on the basis of the instructions and funding received from religious organizations, syndicates, ISI and foreign organizations.

The court, while rejecting the bail application of the accused, said that there is sufficient evidence against them and if they are released on bail, there is a possibility that they will influence the evidence by intimidating the witnesses and may even abscond. The court has said in its order that the bail of Rahul Bhola and other accused in this case has been rejected. In such a situation, it is not proper to release the accused on bail.
