Court rejected the bail plea of the accused of abducting and raping a minor girl in Jhansi. The victim had given statements of voluntarily going, marrying and having physical relations of her own free will.
Special Judge (POCSO Act) Anjana said the victim was a minor at the time of the incident. The acceptance of the minor is unimportant in having a physical relationship with a minor girl. Considering the gravity of the allegation, there is no sufficient ground for granting bail. Therefore the bail application of the accused is dismissed.
The accused are in jail since 7 months
A woman resident of a village in the district had given a complaint in Todifatehpur police station that on the night of March 18, 2021, at around 12 o’clock, her daughter had gone out of the house to do the bathroom. Outside Tehrauli residents Jeetu, Virendra and Pramod were standing with the car. Seducing the daughter and taking her away in the car. The police had arrested Virendra’s son Bhajju after registering a case. The accused is in jail since 6 September 2021. The police had filed a charge sheet against him in the court under sections 376, 363, 366 of IPC and section II of POCSO X.

The court said that the accused is named in the FIR. He is accused of abducting the victim, marrying her and raping her. In her statement, the victim has stated that she had voluntarily going, marrying and having physical relations with the accused of her own free will.
Even if she went with the accused of her own free will, her volition or not knowing did not reduce the gravity of the crime, as she was a minor at the time of the incident.
The acceptance of the minor is unimportant in having a physical relationship with a minor girl. Keeping in view the gravity of the offence, the grounds for granting bail to the accused are not sufficient. The court on Thursday rejected the bail plea of accused Virendra.
