Muzaffarnagar’s CO City Kuldeep Singh has got relief from the court. The CJM court, after hearing, dismissed the application for filing a complaint against the CO for obstructing the investigation of the dowry harassment case.
this was the whole matter
Monika, daughter of Meerapur resident Kushalveer, was married to police constable Sachin, resident of Nanhera village in 2018. Sachin is posted in Azamgarh. It is alleged that a few days after the marriage, Sachin started harassing his wife Monika, demanding an additional dowry of Rs 10 lakh. It is alleged that on July 13, 2020, Monica was thrown out of the house by the in-laws. After which Monica had a daughter Pari. It is alleged that one day Sachin snatched daughter Pari from Monica and took her to the little boy. After which a case was registered against Sachin on the orders of the court on dowry harassment and other serious charges.
The CO was accused of interfering in the investigation
By giving a prayer to the SSP, Kushalveer had alleged that on the orders of the court, CO City Kuldeep Singh was obstructing the investigation of the dowry harassment case filed against Sachin etc. It was alleged that CO City is doing this because of being a relative of Sachin. After which, through his advocate, he filed an application under 156/3 CrPC in the CJM Court and requested for an order to file a complaint against the CO in this matter. It was alleged that when he met CO City Kuldeep Singh at his office, he kept him in illegal custody for several hours. At the same time, he was threatened that the matter should be settled. Otherwise his daughter Monica will be implicated in many big cases.
CJM court rejected the application
CJM Court heard the application filed against CO City Kuldeep Singh. After the hearing, it was arranged that according to the provisions of 195 CrPC, if the higher authority interferes in the work being done by the discriminant in the discharge of his official duties, then the discriminant or his higher officer can file a complaint. The defense counsel also raised the question that after one and a half months after the incident which was mentioned in the application accusing the CO City, it was complained to the SSP. CJM Manoj Kumar Jatav, after hearing the arguments of both the sides, refused to order the registration of the complaint and dismissed the application.
