Those parties whose number of MLAs are very less, the Speaker decides on them at his discretion. There is currently no rule in force regarding the minimum number.
Actually, this time 8 MLAs of Rashtriya Lok Dal have won in the election. In 2017, he had only one MLA. Hence the office was not allotted.
