New Delhi: Former UP cabinet minister and Samajwadi Party MLA Azam Khan has got relief from the Supreme Court in the land acquisition case of Maulana Mohammad Ali Jauhar Trust in Rampur. The Supreme Court has stayed the Allahabad High Court’s decision, in which the government was given the green signal for the takeover of Jauhar University land. The Supreme Court has issued a notice to the UP government and sought its response. The next hearing will be held in August. Till then, Azam Khan has got relief in the takeover of the land. SP MLA Azam Khan and his family members are the trustees of this university.
In 2005, the then UP government had approved 400 acres of land to the Maulana Mohammad Ali Jauhar Trust of Azam Khan in Rampur, UP. Out of this, 12.50 acres of land was sealed to build Jauhar University. After this, 45.1 acres and 25 acres of additional land were approved in the year 2006. Later, the UP government said that the acquisition of the university’s land was illegal except 12 and a half acres, which should be returned to the government as the trust did not comply with the conditions.
In his report, the SDM accused the trust of violating the conditions. The report said that construction work is being done in 24,000 square meters of land. In case of violation of the conditions, the land should be vested back in the state government. ADM Finance ordered to hand over the rest of the land to the government. This was challenged in the High Court on behalf of the Trust. In its order given last year, the court upheld the order of ADM Finance to return the rest of the land to the state government except 12.50 acres.
The High Court had said in its order that the Scheduled Caste land was taken illegally without the permission of the District Magistrate. In violation of the conditions of acquisition, instead of construction for educational work, the mosque was built. The Chak Road land for public use of the Gram Sabha and the government land on the river bank were taken away. The farmers were forcibly made in bondage. 26 farmers had also lodged an FIR against Azam Khan.
Azam Khan reached the Supreme Court against this order of the High Court. After this, the UP government also filed a caveat in the Supreme Court and requested to hear its side. During the hearing held on Monday, Solicitor General Tushar Mehta on behalf of the UP government opposed the petition of the university. He said that the land was given for education, but it was used for other activities. The process of takeover of university land has also started. But the Supreme Court stayed the order of the High Court and sought an answer from the UP government.
